CCTV News: According to the website of the State Administration for Market Regulation, recently, the State Administration for Market Regulation issued the "Decision of the State Administration for Market Regulation on Amending the Supervision and Administration of the Main Responsibility of Enterprises in Implementing Food Safety", and amending the "Regulations on Supervision and Administration of Enterprises in Implementing Food Safety Responsibility" to the "Regulations on Supervision and Administration of Food Production and Operation Enterprises in Implementing Food Safety Responsibility" (hereinafter referred to as the "Regulations"), which will come into effect on April 15, 2025.
Food production and operation enterprises are the first responsible person for food safety. Strengthening the main responsibility of enterprises is the key to doing a good job in food safety. The "Regulations" implement the main responsibility for food safety in the "small unit" by grasping the "three types of people", managing the "three things", and remembering the "three accounts", so as to achieve accurate prevention and control of risks, ensuring that people can be found, things can be checked, and responsibilities can be ended after problems arise.
The Regulations have a total of 24 articles, and have been revised in response to new situations and new problems that arise in the process of implementing the main responsibilities of enterprises, from the aspects of scope of application, risk reporting, work mechanism connection, supervision and random examinations, and definition of food safety management personnel. The main contents are as follows:
First, adjust the scope of application of regulations and improve the main responsibility system for food safety. The "Regulations" clearly state that the regulations apply to the behavior of food production and operation enterprises and relevant personnel in implementing food safety responsibilities and their supervision and management, and are separately legislated with the provisions on the implementation of the main responsibility for food safety in centralized dining units, and non-food producers and operators engaged in food storage business with special requirements for temperature and humidity are included in the scope of application of the regulations. It is stipulated that if food production and operation enterprises discover potential risks of food safety accidents, they shall immediately stop food production and operation activities and report to the county-level market supervision department where they are located.
The second is to optimize the work system and mechanism to avoid increasing unnecessary burdens for enterprises. The "Regulations" clearly state that the "daily control, weekly inspection, and monthly dispatch" system is implemented during production and operation periods, and at the same time, the "Food Safety Risk Control List" is solidified into a system document. It is stipulated that food production and operation enterprises can organically implement the "daily control, weekly inspection, and monthly dispatch" work system and mechanism with established work systems and mechanisms to avoid repeating the same work in actual implementation.
The third is to refine the specific regulatory requirements and respond to the problems faced by grassroots regulatory practice. The "Regulations" supplement and improve the definitions of the main person in charge, food safety director, and food safety officer, and clarify that the food safety director should be the management personnel of the food production and operation enterprise. It is stipulated that the methods and contents of supervision, random inspection and assessment should be consistent with the job responsibilities of the candidates who are randomly tested, and the food safety director and food safety officer will participate in the training for no less than 40 hours each year.
