The State Council and the Central Military Commission recently announced the revised "Measures for the Implementation of the Drug Administration Law of the People's Republic of China" (hereinafter referred to as the "Measures"). The Measures will come into effect on June 1, 2025, with a total of 7 chapters and 60 articles, mainly revising the following contents.
First, adhere to the leadership of the Party and improve the work system. It is stipulated that the military drug management work adheres to the leadership of the Communist Party of China, adheres to the principles of risk management, full-process control, and military-civilian coordination; clarify the division of responsibilities of military-civilian units; and strengthen military-civilian drug management cooperation.
The second is to strengthen the management of military drug reserves and ensure the supply of drugs. Improve the military drug reserve system, standardize the military drug procurement management, and improve the military drug supply management.
The third is to standardize the pharmaceutical management of military medical institutions and promote rational use of drugs. Military medical institutions are required to be equipped with qualified pharmacists or other pharmacist technicians, clarify the issuing authority of the preparation license and preparation approval certificate documents of military medical institutions, and improve the preparation adjustment and use system for medical institutions.
The fourth is to refine the management of special drugs in the military to ensure the quality of drugs. Clarify the registration procedures for special-needed drugs in the military, strengthen the production management of special-needed drugs in the military, and increase the provisions of the military-civilian technical support cooperation mechanism.
Fifth, strengthen the supervision and management of military drugs to ensure drug safety. Clarify the military's supervision and inspection responsibilities, improve the military's drug quality spot check and inspection system, increase the military's drug safety risk control regulations, improve the mechanism for investigating and punishing illegal acts in the military and local areas, and improve relevant legal responsibilities.
