The reporter learned from the State Administration for Market Regulation today that in order to thoroughly implement the "Regulations on Fair Competition Review", strengthen the rigid constraints on fair competition review, maintain the order of fair competition market, and accelerate the construction of a unified national market, the State Administration for Market Regulation issued the "Regulations on Fair Competition Review", which will be officially implemented on April 20.

The "Implementation Measures" has a total of 48 articles. Under the framework of the "Implementation Measures", the overall requirements for fair competition review, departmental responsibilities, review standards, review mechanisms, review procedures and supervision and guarantee measures have been refined and improved. The main contents are as follows:

First, clarify the overall requirements for fair competition review. The "Implementation Measures" clarify the scope of fair competition review; determine the specific responsibilities of the State Administration for Market Regulation and local market supervision departments at or above the county level to guide and organize the implementation of the fair competition review system; strengthen the responsibilities of the document drafting unit to implement the fair competition review system, improve the fair competition review mechanism, strengthen the construction of fair competition review capacity, and strengthen the guarantee of fair competition review work.

The second is to refine the review standards. The review standards for the four aspects of restricting or disguised restrictions on market access and exit, restricting the free flow of commodity elements, affecting production and operation costs, and affecting production and operation behavior are refined into 66 specific circumstances, so as to facilitate market supervision departments and policy measures drafting units at all levels to accurately understand and standardize the application; clarify the meaning of concepts such as "no alternatives with less impact on fair competition" and "reasonable implementation period" in the exception provisions to prevent exception provisions from being abused and damaging market competition.

The third is to improve the review mechanism. Put forward specific requirements on the procedures and contents of the drafting unit for conducting fair competition review, clarify the methods and scope of listening to the opinions of stakeholders, etc.; refine the scope of policies and measures and work procedures for conducting fair competition review by the market supervision department in conjunction with the drafting unit for conducting fair competition review.

The fourth is to strengthen supervision and guarantee. Improve the procedures for handling fair competition review and reporting, establish and improve the fair competition review and spot check mechanism, and stipulate measures such as urging rectification, interviews, written reminders, and administrative suggestions for acts that violate the provisions of the Regulations, and make good connections with the Anti-Monopoly Law, further strengthen accountability and ensure the implementation of the system.
