The Supreme People's Court today (6th) released three typical cases of crimes that people's courts have tried in accordance with the law for damaging black soil resources.

Case 1: Liu Moumou illegally occupied agricultural land

Case 2: The crime of illegal mining of Li Moumou and others

These typical cases have the following characteristics:

First, severely punishing the illegal and criminal acts of digging black soil indiscriminately. Black soil has good soil properties, high fertility, and coordinated water, fertilizer, gas and heat. It is not only a high-quality agricultural production means, but also very popular among nursery bases and flower markets. In recent years, cases of stealing and indiscriminate black soil have occurred frequently. Case 1: Liu Moumou illegally stole more than 3,000 cubic meters of black soil in other people's arable land, causing serious damage to the black soil resources and was held criminally responsible for illegal occupation of agricultural land. This case is of guiding significance for handling crimes such as theft and indiscriminate digging of black soil resources, how the people's courts should accurately apply the crime and properly convict and sentencing.

The second is to severely punish the act of covering up theft of peat soil in legal form. Peat soil is a precious black soil resource and an important mineral resource in our country, with strategic significance and economic value. In recent years, driven by interests, some criminals have taken risks, and illegal mining and selling peat soil have occurred frequently. Some have also covered up the criminal activities of stealing peat soil in the name of legal activities and tried to evade sanctions. Case 2: After Li Moumou and others contracted and operated forest land under the guise of investment, they frantically stole peat soil, seriously damaged the black soil resources and ecological environment. They were eventually held criminally responsible for the crime of illegal mining and assumed responsibility for ecological environment restoration. This case has effectively deterred the crime of illegal mining-type black soil resource destruction, and fully demonstrated the judicial orientation of the people's courts to fully protect the black soil and consolidate the foundation of food security.

The third is to severely punish acts that pollute black soil. The formation process of black soil is long. Once the black soil layer is polluted, the "fertile land" becomes "toxic land". Toxic substances seriously damage food security and endanger people's lives and health. Moreover, polluted black soil is extremely difficult to control and repair. Therefore, crimes of polluted black soil must be severely punished in accordance with the law. Case 3: A technology company and other units and individuals transported more than 200 tons of hazardous waste across provinces, illegally dumped on black soil, causing major pollution consequences, and were held criminally responsible for the crime of polluting the environment. This case severely punishes cross-border black soil pollution crimes in accordance with the law, which is conducive to promoting the source prevention and control and systematic governance of black soil pollution, and fully reflects the responsibility of the people's courts to adhere to the strictest systems and the most stringent rule of law and contribute their judicial strength to protect the "rice bowl" of the Chinese people.
