Ministry of Commerce: Preliminary determination of dumping of imported pecans originating in Mexico and the United States

CCTV News: In accordance with the provisions of the Anti-dumping Regulations of the People's Republic of China (hereinafter referred to as the "Anti-dumping Regulations"), on September 25, 2025, the Ministry of Commerce (hereinafter referred to as the investigation agency) issued Announcement No. 52 of 2025, deciding to initiate an anti-dumping investigation into imported pecans originating in Mexico and the United States (hereinafter referred to as the product under investigation).

The investigation authority investigated whether there was dumping and dumping margin of the products under investigation, whether the products under investigation caused damage to China’s domestic industry and the extent of the damage, and the causal relationship between dumping and damage.Based on the investigation results and the provisions of Article 24 of the Anti-dumping Regulations, the investigation agency made a preliminary ruling.The relevant matters are now announced as follows:

1. Preliminary Ruling

The investigation agency has initially determined that imported pecans originating in Mexico and the United States have been dumped, and China's domestic pecan industry has been substantially damaged, and there is a causal relationship between dumping and substantive damage.

2. Collection of deposits

According to the provisions of Articles 28 and 29 of the Anti-dumping Regulations, the investigation agency decided to implement temporary anti-dumping measures in the form of deposits.Starting from August 11, 2026, when importing products under investigation, import operators should provide corresponding deposits to the Customs of the People's Republic of China based on the margin ratio of each company determined in this preliminary ruling.

The specific description of the products under investigation is as follows:

Scope of investigation: imported fresh or dried pecans originating from Mexico and the United States.

Name of the product under investigation: fresh or dried pecans (American pecans, thin-shelled pecans).

Foreign name: Carya illinoensis.

Product description: The seeds of the thin-shelled pecan of the Juglandaceae family; fresh pecans or pecan fruits as raw materials, made through selection, drying and other processes, regardless of whether they are shelled or peeled, are mainly nuts for human consumption.

Main uses: Pecans can be eaten raw or fried, and can also be used to make various snacks or extract oil.

This product falls under the "Import and Export Tariff of the People's Republic of China": 08029990. Other products under this tariff number are not within the scope of this investigation.

3. Method of collecting deposits

From August 11, 2026, when importing pecans originating in Mexico and the United States, import operators should provide corresponding deposits to the Customs of the People's Republic of China based on the margin ratio of each company determined in this preliminary ruling.The deposit is levied ad valorem based on the taxable price of the imported goods determined by the customs. The calculation formula is: deposit amount = (the taxable price of the imported goods determined by the customs × deposit collection ratio) × (1 + import VAT rate).

IV. Comments

Each interested party may submit written comments to the investigating agency within 10 days from the date of this announcement.
