CCTV News: On August 19, the spokesperson of the Ministry of Justice responded to a reporter’s question on the EU’s foreign subsidy investigation-related practices that constitute inappropriate extraterritorial jurisdiction.

Q: On August 19, 2026, the Ministry of Justice issued an announcement stating that the EU’s use of its Foreign Subsidy Regulations to conduct relevant cross-border investigations against Chinese entities in the investigation of JD.com constituted improper extraterritorial jurisdiction. What are your considerations?

Answer: Recently, the EU used its Foreign Subsidy Regulations to investigate JD.com and arbitrarily requested extensive and unnecessary cross-border information from Chinese entities. This is an inappropriate requirement imposed on relevant entities and a serious damage to the international rule of law.In order to safeguard national sovereignty, security and development interests, and protect the legitimate rights and interests of Chinese citizens, legal persons or other organizations, the Ministry of Justice, in accordance with the Regulations of the People's Republic of China on Countering Improper Extraterritorial Jurisdiction by Foreign Countries, together with the Ministry of Commerce and other relevant departments, determined that the EU's above-mentioned practices constituted inappropriate extraterritorial jurisdictional measures, and required no organization or individual to implement or assist in the implementation of such measures. It is hoped that the European side will immediately correct its wrong practices, stop abusing "foreign subsidy" investigation tools, and create a fair, just and predictable market environment for enterprises investing and operating in Europe. If the European side insists on going its own way, China will resolutely counterattack in accordance with the law.
